Disputes Committee
The Panel established the Disputes Committee in accordance with Schedule 9 of the Market Arrangements Code (MAC). The Disputes Committee is a Committee of the Panel and its authority is assigned as such.
What does the committee do?
The purpose of the Disputes Committee is to determine the outcomes of Trading, Non-Trading, Market Operator (MO) and Market Arrangements Code (MAC) Disputes. It may also recommend changes to the market codes which support procedures to resolve disputes.
Decision Making
The Disputes Committee will base its decision of a dispute on the issue raised, the information provided, and the relevant provisions of the Code.
Where such a decision involves the action(s) of an exiting Undertaker and/or an acquiring Licensee, the Disputes Committee will assume the total transfer of responsibilities and liabilities to the acquiring Licensee. If a transfer scheme has been applied under The Water and Sewerage Undertakers (Exit from Non-household Retail Market) Regulations 2016 that varies this transfer of responsibility, then trading parties should provide evidence of these variations to the Disputes Committee to be taken into consideration.

Committee members
The Disputes Committee will consist of 10 members with relevant water and sewerage industry experience, as set out in Section 1.3 (Schedule 9) of the Market Arrangements Code (MAC). The current members are:

To maintain the impartiality and independence of members, and as outlined in the MOSL Code of Conduct, trading parties should not contact individual Committee members regarding disputes.
